Terms of Service

Last updated October 12, 2026

These terms are an agreement between 1001549351 Ontario Inc. ("Onus", "we", "us") and the business that uses Onus (the "Customer", "you"). They apply to the Onus website and app (the "Service"). By using the Service, you agree to these terms on behalf of your business. If you and Onus have signed a separate written agreement, that agreement takes priority where it differs from these terms.

1. Who can use Onus

Onus is a business tool for insurance restoration companies in Canada. Accounts are by invitation only. You must be authorized by your business to accept these terms and to use the Service.

2. Accounts

  • Each person needs their own account. Do not share sign-in details.
  • You are responsible for everything done under your company's accounts.
  • Your company administrator controls who has access and should remove people who leave.
  • Tell us right away if you think an account has been used without permission.

3. Your information

You own the information you put into Onus ("Customer Data"), including claim details, photos, notes and reports. You give Onus permission to store, process and display Customer Data only to provide and support the Service, as described in our Privacy Policy.

You are responsible for having the right to collect and share any personal information you put into Onus, including information about property owners and other people involved in a claim, and for meeting your own privacy obligations to them.

4. Acceptable use

You agree not to:

  • use the Service for anything unlawful, or to store information you have no right to hold;
  • try to access another company's information, or get around security or access controls;
  • interfere with the Service, overload it, or use automated tools to copy or scrape it;
  • copy, resell or reverse engineer the Service, or use it to build a competing product.

5. Important limits on what Onus does

Onus is a tool to help you manage claims. It does not replace your own judgment or your obligations to insurers, property owners or anyone else. In particular:

  • Deadlines: Onus works out deadlines from the information it receives and from carrier requirements as we understand them. Carrier requirements change, and information may be incomplete or late. You remain responsible for knowing and meeting each carrier's requirements.
  • Alerts: text message and email alerts depend on phone networks, email providers and other services outside our control. They can be delayed or fail. Do not rely on alerts as your only reminder.
  • Automatic claim setup: claims created from forwarded emails or spreadsheets should be checked. Onus may misread information that arrives in an unexpected format.
  • Writing help: wording suggested by artificial intelligence can be wrong. Review all text before you send it to anyone.
  • Not professional advice: nothing in Onus is legal, insurance, engineering or other professional advice.

6. Fees

Fees, billing terms and any trial period are set out in your order or written agreement with Onus. Unless that agreement says otherwise, fees are in Canadian dollars and do not include taxes.

7. Changes to the Service

We are improving Onus all the time, so features may be added, changed or removed. We will give reasonable notice before removing a feature your business relies on.

8. Third-party services

Onus works with services run by other companies, such as sign-in with Google or Microsoft, calendars, electronic signatures and claim systems. Those services have their own terms, and we are not responsible for them.

9. Our property

Onus, including its software, design, carrier workflows and content (other than Customer Data), belongs to us. These terms give you a right to use the Service while your account is active, not ownership of it. If you send us suggestions, we may use them without owing you anything.

10. Disclaimer

To the extent the law allows, the Service is provided "as is" and "as available". We do not promise that it will be uninterrupted, error free, or suited to every purpose, and we disclaim all implied warranties and conditions, including merchantability, fitness for a particular purpose and non-infringement.

11. Limit of liability

To the extent the law allows, Onus is not liable for indirect, incidental, special or consequential losses, or for lost profits, lost revenue, lost data, missed deadlines, or penalties or charge-backs from insurers, even if we were told they were possible. Our total liability for all claims relating to the Service is limited to the fees you paid us in the 12 months before the event that gave rise to the claim.

12. Indemnity

You agree to cover our reasonable losses and costs if a third party makes a claim against us because of Customer Data you supplied without the right to do so, or because of your breach of these terms.

13. Suspension and ending the agreement

You may stop using the Service at any time, subject to your order or written agreement. We may suspend or close an account that breaks these terms or puts the Service or other customers at risk, and will give notice where we reasonably can. When your account closes, you can ask for a copy of your Customer Data within a period we will tell you about at the time. After that period, we delete it, except where the law requires us to keep it.

14. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be decided by the courts of Ontario, and both parties accept their jurisdiction.

15. Changes to these terms

We may update these terms. We will show the date of the last update at the top of this page and tell customers about significant changes before they take effect. Continuing to use the Service after a change takes effect means you accept the updated terms.

16. Contact

Questions about these terms can be sent through our contact form.
